UPSTRM Terms of Service

1. Acceptance of Terms

By accessing or using UPSTRM (“the Service”), you agree to be bound by these Terms of Service. If you don’t agree to these terms, please don’t use the Service.

2. Description of Service

UPSTRM is a community-driven directory and discovery platform for Model Context Protocol (MCP) servers. Users can:

• List and discover MCP servers
• Curate collections
• Participate in community discussions
• Earn points through contributions
• Follow other users and collections

Important: UPSTRM is a directory only. We do not develop, maintain, or operate the MCP servers listed on our platform. All servers are created and operated by independent third parties.

3. User Accounts

Account Creation

• You must provide accurate information when creating an account
• You must be at least 13 years old to use UPSTRM
• You are responsible for maintaining the security of your account
• You are responsible for all activity under your account

Account Termination

• You may delete your account at any time by contacting us
• We may suspend or terminate accounts that violate these terms
• We reserve the right to refuse service to anyone

4. Listing MCP Servers

Discovery Model

• Any user may list any publicly available MCP server
• You do not need to be the creator of a server to list it
• The first person to list a server receives discovery credit
• Server creators can claim their listings through verification

Your Responsibilities When Listing

You agree to:

• Provide accurate information about servers
• Not misrepresent server functionality
• Respect intellectual property rights
• Not list malicious or harmful software
• Update listings if information changes

Verification

• Creators can verify ownership by adding our badge to their GitHub README or the server’s website
• Verification is optional but encouraged
• Verified creators receive special recognition

5. User-Generated Content

What You Can Post

• Server listings
• Comments and reviews
• Collections and curated lists
• Profile information

Content Rules

You may not post content that:

• Violates laws or regulations
• Infringes intellectual property rights
• Contains malware or malicious code
• Promotes illegal activity
• Harasses or threatens others
• Contains hate speech or discrimination
• Is sexually explicit (unless properly labeled)
• Is spam or manipulative
• Misleads users about server functionality

Content Ownership

• You retain ownership of content you post
• You grant UPSTRM a license to display, distribute, and promote your content
• You can delete your content at any time
• We may remove content that violates these terms

6. Community Guidelines

Acceptable Use

• Treat other users with respect
• Engage in good faith discussions
• Report problems through proper channels
• Follow the spirit of community collaboration

Prohibited Activities

• Gaming the points system
• Creating fake accounts or sock puppets
• Vote manipulation or review fraud
• Scraping or automated data collection (except via our API)
• Harassment or bullying
• Impersonation
• Spamming or unsolicited promotion

7. Points and Gamification

How Points Work

• Points are earned through community contributions
• Points determine your level and unlock features
• Points have no monetary value
• We reserve the right to adjust point calculations

Points Abuse

• We may reset or remove points earned through manipulation
• Repeated abuse may result in account suspension
• Points cannot be transferred or sold

• Priority support

Billing

• Pro subscriptions are billed monthly
• You can cancel at any time
• No refunds for partial months
• We may change pricing with 30 days notice

Free Trial

• New Pro users may receive a free trial period
• You won’t be charged until the trial ends
• Cancel anytime during trial to avoid charges

9. Third-Party Servers and Content

Disclaimer

CRITICAL: UPSTRM does not operate, maintain, or control any MCP servers listed on our platform. All servers are created and operated by independent third parties.

Your Use of Third-Party Servers

• You install and use servers at your own risk
• We do not verify server security or functionality
• We are not responsible for server performance, data handling, or security
• Check each server’s repository and documentation before installing
• Review server permissions and access requirements

No Warranties

We make no warranties about:

• Server availability or uptime
• Server security or data protection
• Server functionality or accuracy
• Server compliance with laws or regulations

10. Intellectual Property

DMCA Compliance

• We respect intellectual property rights
• If you believe content infringes your copyright, file a DMCA notice

• False DMCA claims may result in liability

11. Privacy

Your privacy is important to us. Our practices are detailed in our Privacy Policy, which is incorporated into these Terms by reference.

12. API Usage

API Terms

• Use the API for legitimate purposes only

• Respect rate limits and usage guidelines

13. Moderation and Enforcement

Reporting

• We review reports within 24-48 hours
• False reports may result in account action

Appeals

14. Disclaimers and Limitations

Service “As Is”

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UPSTRM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Third-Party Liability

WE ARE NOT LIABLE FOR ANY DAMAGES CAUSED BY THIRD-PARTY MCP SERVERS, INCLUDING BUT NOT LIMITED TO DATA LOSS, SECURITY BREACHES, OR SERVICE INTERRUPTIONS.

15. Indemnification

You agree to indemnify and hold UPSTRM harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Content you post or servers you list

16. Changes to Terms

• We may update these Terms at any time
• Material changes will be notified via email or platform notice
• Continued use after changes constitutes acceptance
• If you don’t agree to changes, stop using the Service

17. Termination

By You

• You may stop using the Service at any time
• You may delete your account by contacting us

By Us

We may terminate or suspend your account if:

• You violate these Terms
• Your account is inactive for extended periods
• Required by law
• We discontinue the Service

Effect of Termination

• Your right to use the Service ends immediately
• We may delete your account data
• Some provisions survive termination (disclaimers, indemnification)

18. General Provisions

Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and UPSTRM.

Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

No Waiver

Our failure to enforce any right doesn’t waive that right.

Assignment

You may not assign these Terms. We may assign them without restriction.

Force Majeure

We’re not liable for delays or failures due to circumstances beyond our control.
